Terms of Service

These terms govern your use of marketkloud.com and MarketKloud Forms (forms.marketkloud.com), operated by MarketKloud ("we," "us," "our"). By creating an account or using our products, you agree to these terms.

1. Accounts

You're responsible for maintaining the security of your account and for all activity under it. You must provide accurate information when signing up. You may not share your account credentials or let others act as you.

2. Plans and billing

MarketKloud Forms offers a free plan and paid tiers with higher usage limits, described at forms.marketkloud.com/pricing. Selecting a paid plan is currently recorded as your workspace's tier; if and when self-serve billing is introduced, you'll be notified before any payment is collected. You can request a plan change or account cancellation at any time from Admin Settings.

3. Acceptable use

You agree not to use MarketKloud Forms to:

• Send spam, phishing content, or unsolicited bulk communications.
• Collect sensitive personal data (e.g. health, financial, or government ID information) without a lawful basis and appropriate safeguards.
• Violate any applicable law, or the rights of any third party.
• Attempt to interfere with, disrupt, or gain unauthorized access to our systems.
• Resell or white-label the product without our prior written consent.

4. Your content and data

You retain ownership of the forms you create and the responses you collect. You're responsible for having the right to collect and process any personal data your forms gather from respondents, and for complying with applicable privacy laws (e.g. GDPR, CCPA) with respect to that data — we act as a processor on your behalf, as described in our Privacy Policy.

5. Connected third-party accounts

If you connect a Google, Microsoft, or other email account to send form notifications from your own mailbox, you're responsible for complying with that provider's own terms of service (including their sending limits). We're not responsible for failures caused by your connected provider, and automatically fall back to our own email delivery if your connected account is unavailable.

6. Service availability

We aim for high availability but don't guarantee uninterrupted service. We may perform maintenance, and features may change over time as the product evolves.

7. Termination

You may delete your account at any time from Admin Settings → Danger Zone, which immediately and permanently removes your data. We may suspend or terminate accounts that violate these terms, with notice where reasonably possible.

8. Disclaimers and limitation of liability

The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, MarketKloud is not liable for indirect, incidental, or consequential damages arising from your use of the product.

9. Changes to these terms

We may update these terms from time to time. Material changes will be reflected by updating the "Last updated" date above; continued use after changes take effect constitutes acceptance.
